Effective date: January 1, 2026

These Terms of Use ("Terms") govern your access to and use of the ECE Architects Training Institute online learning platform at tamara-s-site-15d0.thinkific.com and related pages (the "Platform"), operated by The ECE Architects ("we," "us," or "our"). By creating an account, enrolling in a course, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility and Accounts

The Platform is intended for adult early childhood professionals and other adult learners. You must provide accurate information when you register and keep it current. You are responsible for all activity under your account and for keeping your login credentials confidential. Accounts are for a single individual. You may not share, sell, or transfer your account or credentials, and you may not allow anyone else to access the Platform using your account.

2. Your License to Use the Content

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the courses and materials you are enrolled in, solely for your own professional development. This license does not transfer any ownership to you, and we reserve all rights not expressly granted.

3. Our Intellectual Property, and What You May Not Do

All content on the Platform, including every course, video, presentation, slide, workbook, handout, assessment, quiz, rubric, certificate, framework, method, system, text, graphic, image, logo, name, and trademark, is the exclusive property of The ECE Architects and is protected by United States and international copyright, trademark, and other intellectual property laws. Our proprietary systems and marks, including The ECE Architects™, The ECEA Educator Academy™, and our other named programs and tools, are our trademarks and may not be used without our prior written permission.

You may not, under any circumstances, copy, reproduce, republish, download (except where a file is expressly provided for download), record, screen-record, screenshot, photograph, upload, post, transmit, distribute, display, perform, share, sell, resell, license, sublicense, rent, lease, loan, or otherwise make available any part of our content to any other person or platform. You may not create derivative works from our content, remove or alter any copyright or trademark notice, scrape or use automated means to extract content, or use our content or trademarks to create, market, or operate any competing course, training, product, or service. Nothing on the Platform grants you any right to use our materials for any commercial purpose or for training anyone other than yourself.

These restrictions apply during and after your use of the Platform. Any unauthorized use immediately terminates the license granted in Section 2 and may subject you to civil and criminal liability. We reserve the right to pursue all available remedies, including injunctive relief and damages, and to recover our costs and attorneys' fees.

4. Acceptable Use

You agree to use the Platform lawfully and respectfully. You may not attempt to gain unauthorized access to the Platform or other users' accounts, interfere with or disrupt the Platform, introduce malicious code, harass other users, or use the Platform in any way that violates these Terms or applicable law.

5. Enrollment, Fees, and Certificates

Some courses are offered at no cost and others may require payment; the terms shown at enrollment apply. Certificates of completion are issued when you meet a course's completion requirements, including any required passing score. A certificate confirms completion of the training described on it and does not constitute a license, endorsement, or professional credential beyond what is stated. We may correct or reissue certificates where needed to fix errors.

6. Disclaimers

The Platform and its content are provided for professional development and informational purposes and are offered "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted or error-free, and our content is not legal, medical, or other professional advice for any specific situation. You are responsible for meeting the licensing, accreditation, and regulatory requirements that apply to you.

7. Limitation of Liability

To the fullest extent permitted by law, The ECE Architects will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the amount you paid us, if any, for the course giving rise to the claim.

8. Termination

We may suspend or terminate your access at any time, without notice, if you violate these Terms, including any misuse of our intellectual property. On termination, your license to access the content ends immediately. Sections concerning intellectual property, disclaimers, limitation of liability, and governing law survive termination.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Platform after changes take effect means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of laws rules. You agree that any dispute will be resolved in the state or federal courts located in Michigan.
